1.1 The Desiknio website (www.desiknio.com) is an informational platform operated by myStromer AG under the Desiknio brand. The website presents Desiknio's range of lightweight electric bicycles (pedelecs, i.e. electrically assisted pedal cycles with motor assistance up to 25 km/h in accordance with EU Regulation No 168/2013 and corresponding Swiss legislation). The website does not offer direct online sales to end consumers.
1.2 Desiknio products are sold exclusively through an authorised dealer network. Customers wishing to purchase a Desiknio pedelec should contact their nearest authorised dealer, who will conclude the purchase contract directly with the customer.
1.3 These General Terms & Conditions ("T&Cs") govern the use of the website and the services available on it, including the test ride booking feature. They do not govern the individual purchase contracts concluded between customers and authorised dealers, which are subject to the dealer's own terms and conditions.
1.4 These T&Cs apply in the version current at the time of use of the website or the relevant service.
2.1 These T&Cs govern the relationship between the user of the website ("you" or "the user") and myStromer AG, Freiburgstrasse 798, CH-3173 Oberwangen, Switzerland ("Desiknio", "we" or "us") in connection with the use of the website and its services.
2.2 These T&Cs apply exclusively. Any conflicting or deviating conditions of the user will only be recognised if we have expressly approved them in writing.
2.3 These T&Cs apply in the version current at the time the relevant service is used.
3.1 The content of the website – including product descriptions, images, technical specifications, videos and other materials – is provided for informational purposes only. All content is subject to change without notice. Images shown are for illustration purposes and are not binding.
3.2 The website may contain links to authorised dealers or third-party websites. Such links are provided for convenience only. We accept no responsibility for the content, accuracy or availability of third-party websites.
3.3 You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of third parties or restrict their use of the website. In particular, you must not:
4.1 The website offers users the option to request a test ride of a Desiknio pedelec at an authorised dealer. The test ride booking function is a non-binding enquiry service; it does not constitute an offer or a binding reservation until confirmed by the relevant authorised dealer.
4.2 By submitting a test ride request, the user authorises myStromer AG and the relevant authorised dealer to contact them for the purpose of scheduling the test ride appointment.
4.3 Test ride bookings are subject to dealer availability. myStromer AG accepts no liability for the availability of specific models, dates or locations. The test ride itself is conducted by and under the responsibility of the authorised dealer.
4.4 During any test ride, the user must comply with all applicable road traffic regulations and the instructions of the dealer. The user is responsible for ensuring that they hold any licence or certification required to ride a pedelec in their country of residence. Please note that, unlike Stromer speed pedelecs (which can require a moped licence in certain jurisdictions), Desiknio pedelecs are standard electrically assisted pedal cycles (up to 25 km/h motor assistance) and generally do not require a motor vehicle licence in Switzerland or the EU. Users are advised to verify local requirements.
4.5 Personal data submitted via the test ride booking form is processed in accordance with our Privacy Policy (www.desiknio.com/privacy-policy).
5.1 Product information, technical specifications and price indications published on the website are for informational purposes only and do not constitute a binding offer. Prices shown are indicative and include VAT where applicable; final pricing is determined by the authorised dealer.
5.2 Desiknio pedelecs are sold exclusively through authorised dealers. No purchase contract is concluded via the website. All purchase agreements are made directly between the customer and the authorised dealer and are governed by the dealer's own terms and conditions.
5.3 As Desiknio products are standard pedelecs (electrically assisted up to 25 km/h), they do not require a vehicle registration, licence plate, compulsory insurance or a motor vehicle licence in most European jurisdictions. Users are responsible for verifying the applicable legal requirements in their country of residence or use.
6.1 Statutory warranty rights as between the customer and the dealer arise under the purchase contract concluded with the authorised dealer and are subject to applicable law.
6.2 myStromer AG provides a manufacturer's guarantee for Desiknio products as described on the website or in the product documentation. The scope and duration of the manufacturer's guarantee are set out in the applicable guarantee conditions available from your authorised dealer or on the website.
6.3 The manufacturer's guarantee does not limit any mandatory statutory rights the customer may have under applicable consumer protection law.
7.1 To the extent permitted by applicable law, myStromer AG excludes liability for any damages arising from the use of, or inability to use, the website or any information contained on it, including but not limited to indirect, consequential or incidental damages.
7.2 This exclusion of liability applies to any breach of duty by myStromer AG or any third party engaged by myStromer AG in connection with the website or its services, regardless of the legal basis of the claim.
7.3 Nothing in these T&Cs excludes or limits liability for fraud, wilful misconduct, gross negligence or any other liability that cannot be excluded under mandatory applicable law. Consumer protection rights mandated by law remain unaffected.
8.1 All content on the website – including text, images, videos, graphics, logos and software – is the property of myStromer AG or its licensors and is protected by Swiss and international copyright, trademark and intellectual property law.
8.2 You may not reproduce, distribute, modify, transmit, reuse or use any content from the website for commercial purposes without our prior written consent. Private, non-commercial use of individual content is permitted provided the source is acknowledged.
9.1 myStromer AG and its authorised dealers comply with applicable Swiss and European data protection law (Swiss nFADP / revDSG and EU GDPR) when processing personal data.
9.2 Details of how personal data is collected, processed and used in connection with the website and its services – including the test ride booking function and the newsletter – are set out in the Desiknio Privacy Policy, available at www.desiknio.com/privacy-policy.
10.1 Amendments and additions to any written agreement require written form and the consent of both parties to be valid. This also applies to any waiver of the written form requirement.
10.2 myStromer AG reserves the right to amend these T&Cs at any time. The version of the T&Cs in force at the time the relevant service is used shall apply.
Should any provision of these T&Cs be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, the valid and enforceable provision that comes closest to the economic purpose of the invalid or unenforceable provision shall be deemed agreed. The same applies if a gap becomes apparent in these T&Cs.
12.1 To the extent permitted by law, the relationship between the user and myStromer AG is governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and any conflict-of-law rules.
12.2 If you are a consumer residing in the European Union, you also benefit from any mandatory consumer protection provisions applicable in your country of residence that cannot be derogated from by agreement.
12.3 Subject to any mandatory statutory provisions to the contrary, any disputes arising out of or in connection with these T&Cs, including their validity, invalidity, breach or termination, shall be subject to the exclusive jurisdiction of the competent courts at the registered seat of myStromer AG in the Canton of Bern, Switzerland.
